Terms of Use and Privacy Policy


Introduction

We want you to maintain a healthy relationship with money. Therefore, we present a simplified version of our Terms of Use and Privacy Policy ("Terms"), using more understandable and less "legalese" language. This way, you can take care of your financial health without any complications. Under these Terms, PotaPay establishes the conditions for using its platform, accessible via the internet for its users ("you"). You understand that, to meet your needs and provide greater security, the platform will be constantly improved in accordance with these Terms, which will always be available on our platform. Therefore, you are responsible for periodically reviewing these Terms to verify if you agree with the updates.

 

Through these Terms of Use and Privacy Policy ("Terms"), PotaPay establishes the conditions for accessing its platform via the internet.

Under these Terms, consider the following:

1. Internet Protocol Address (IP Address): Code assigned to a network terminal to allow its identification, as defined by international parameters.

2. Internet: A system composed of a set of logical protocols, built for public and unrestricted use globally, aimed at transmitting data between terminals through different networks.

3. Password: A set of characters composed of letters and/or numbers, intended to verify the user's identity for access to websites and/or applications.

4. Platform: PotaPay's website and application, through which users can access available services and content.

5. Terminal: Computers, laptops, tablets, and any other devices connected to the internet.

6. User: All natural persons who access the platform, aged 18 or older, or those who are legally capable of performing civil acts or are duly represented or assisted.

 

Acceptance of Terms of Use and Privacy Policy:

By accessing the PotaPay website and/or application, the user fully agrees and accepts these Terms.

1. Registration: Acceptance of the Terms. By creating an account in the application, we consider that you have accepted this contract and its terms and conditions, reaffirming your acceptance with each transaction, even if the terms are changed. You also agree that PotaPay may check your name with credit institutions. If you do not agree with this contract, do not create an account. The platform may have areas of open content and areas of restricted content and/or services. To access the restricted content and/or services, it may be necessary to create a profile with a login and password and/or provide certain personal registration data ("Registration Data"), such as: full name, address, and email. If necessary for user identification and/or access to restricted content and/or services, other registration data may also be required.

2. Accuracy of Data: The user is responsible for the accuracy and truthfulness of the data provided, recognizing that inconsistencies may result in the inability to access the platform.

3. Security of Information: The user is fully responsible for the safekeeping, confidentiality, and proper use of the registered login and password, and PotaPay is not responsible for their improper or involuntary use.

4. Exclusive Use: Login and password are for the exclusive use of the registered user, and sharing with any third party is strictly prohibited.

5. Account Deletion: The user can delete their account at any time, but PotaPay may retain the user's information and/or data and the use of the account for legal purposes and due to activities carried out on the platform.

Declarations Upon Accepting the Terms:

1. Declares to be 18 years old or represented by someone legally capable;

2. Assumes responsibility for any consequences arising from the use of the platform and any judicial or extrajudicial claims, including those from third parties, against PotaPay;

3. Assumes full responsibility for financial operations carried out on the platform, including all risks and losses arising from such operations;

4. Will not use the platform for illegal purposes and will comply with all applicable laws;

5. Recognizes that PotaPay may modify information and/or offers on the platform at any time without compensation;

6. Will not insert harmful elements that may interfere with the normal operation of the platform or damage the systems of PotaPay or third parties;

7. Understands that access to the platform may be suspended or blocked in case of suspected fraud or illegal activity without liability to PotaPay;

8. Understands that accessing the platform through public and unprotected Wi-Fi networks may pose a risk to the information stored on the mobile device and assumes full responsibility for any damage resulting from the use of unsafe public networks;

9. It is prohibited to perform reverse engineering, decompile, disassemble, translate, adapt and/or modify the platform or any other action that allows access to the platform's source code;

10. Commits to keep the mobile application always updated, according to the latest version available in the official app stores of Apple (App Store) and Android (Google Play Store).

General Service Terms Contract

Account: To use the payment services under this contract, you need to register and create an account ("Account") in the application, providing your registration information, which is subject to our review and approval. If your registration is not approved, you will not be able to create an account, or the account may be terminated at any time. If you are under 18, some products and/or services may not be available, as determined by PotaPay.

Wallet: After creating the account, you will have a prepaid payment account ("Wallet") created and managed by us. You can top up, transfer, or receive funds into the Wallet, forming your electronic money balance for withdrawals, transfers, or payments.

Pix: You can also use Pix to top up, pay, receive, and transfer funds to the Wallet.

Rates: Yield rates and indices may change at any time, and you can check the latest conditions through customer service or the application.

Liquidity: Your Wallet balance has daily liquidity, allowing you to withdraw at any time.

Changes or Termination: We may suspend or terminate the generation of yields, or change the yield conditions at any time, especially interest rates and applicable indices.

Taxes: The yields generated by your Wallet or Piggy Bank balance are subject to taxes, which will be withheld by PotaPay before the funds enter the Wallet.

Validity: These terms are valid indefinitely and may be changed at any time. In case of changes, you can check the new conditions through PotaPay's customer service channels or the application.

Fees: Using our products and services may incur relevant fees and/or charges, which will be informed to you when signing up for the service or using the product. PotaPay may, at its sole discretion, decide not to charge or offer more favorable conditions, as long as it is more beneficial for you or based on your relationship level with PotaPay. Favorable conditions can be indefinite or can be stopped at any time, and PotaPay will notify you of the changes.

Promotions: PotaPay may also decide to offer more favorable rates, fees, and/or charges during promotional activities. These promotional conditions are considered unilateral acts and do not constitute a modification of the contract terms or a waiver of rights.

Usage: To use the application, you must:

1. Ensure that the application is downloaded and installed from official stores (Apple Store and Google Play), as we are not responsible for any losses caused by pirated applications;

2. Use the application's services only in your name, as the account is yours and must not be shared;

3. Not share your password, nor allow anyone to use the application in your name or with your information. If you share the application, password, or phone, or lose the device with the application installed without notifying us immediately, you will be responsible for any resulting misconduct. We are not responsible for any direct, indirect, moral, or material damages caused by the improper use of the application or access information (such as email, password, etc.);

4. Confirm the price, conditions, and all relevant fees (such as shipping, handling fees, etc.) when purchasing goods or services from third parties;

5. If you are a freelancer or self-employed, provide only the products and services that you can guarantee delivery and fulfill the conditions agreed upon with the customer.

6. Responsibility for loss, theft, or robbery: You are responsible for storing and correctly using the application, account, wallet, password, facial recognition, and/or fingerprint identification. If the mobile device with the application installed is lost, stolen, or robbed, you must immediately notify PotaPay and provide a police report when requested. PotaPay is not responsible for any losses in your account and wallet before you notify about the loss, theft, or robbery.

7. How it works: The application works as follows:

8. After downloading and installing the application, we need to get to know you. You need to fill out the registration information, which will be subject to our review and approval to start making payments and withdrawing the wallet balance;

9. We can use the information you provide in the application (such as your preferences, messages, and all communications) to assess if your activity complies with this contract and current laws;

10. All transactions made through the application depend on internet access, which you must provide and bear the related costs;

11. Payments made through the application can only be made with the existing balance in your wallet. You need to confirm the payment by entering the password or using the fingerprint;

12. We will analyze the payments made to protect you from potential fraud using our risk analysis tools. If we deem it necessary, we can also cancel the transaction;

13. Once the transaction is completed, we will send a message to your email. If you do not check your email daily, don't worry, the application will record all transactions;

14. You can only make one withdrawal at a time, which will be completed within two business days. As with any transaction, we will review the withdrawal;

15. Whenever a payment is canceled and there is a pending withdrawal, the system will cancel the withdrawal, and you will need to reapply;

16. You must immediately report any errors or misuse of the application through our help center. This information is crucial to maintaining the application's security; and

17. You authorize us to deduct and/or freeze amounts from your account (possibly in multiple steps) and charge you fees, for example, in case of disputes with other users of the application, transaction disputes, suspected fraud or operational failure, and defaults related to PotaPay products and services. Remember that we are just intermediaries and are not responsible for any relationship between you and third parties.

Negative Credit Record: PotaPay reserves the right to record negative credit for those who perform fraudulent and simulated transactions in the application and those who perform abnormal operations that make PotaPay a creditor.

Prohibited Conduct: Certain behaviors are prohibited because they violate our purposes and values. For example, if we detect the following actions in the activities you perform (such as sending messages), your account may be canceled:

1. Violation of laws, especially copyright or industrial property laws; i.e., do not sell pirated products;

2. Practicing any discriminatory behavior and/or encouraging or associating with behavior of hate, intolerance, physical or moral violence, racism, crime promotion, content related to pornography or inappropriate for minors, or directly or indirectly associating the name or brand of PotaPay with these behaviors;

3. Use of illegal labor, such as labor analogous to slavery or child labor, whether directly or indirectly;

4. Employing minors under 18 in places or services that are not conducive to their growth and development, or that interfere with schooling and nighttime work, including apprentices;

5. Engaging in activities that involve profit from criminal behavior, such as prostitution or sexual exploitation;

6. Discrimination in employment or its maintenance based on gender, race, religion, marital status, age, family status, or pregnancy;

7. Practices harmful to the environment;

8. Sending unsolicited advertising material to potential customers;

9. Transmission of programs and files containing any type of virus that may cause harm to the recipient or third parties, or infringe their privacy;

10. Attempting to obtain or obtaining any unauthorized confidential information;

11. Disrupting or damaging application services, servers, or connected networks;

12. Interfering with other users' use of the application;

13. Practicing any action that overloads the application; harming third parties and/or oneself; engaging in improper use or activities on the platform, such as excessive, harassment, abuse, or any form of improper behavior;

14. Unauthorized association of PotaPay's image and/or brand with political, union, religious activities, or activities related to the aforementioned behaviors;

15. Copying, reproducing, modifying, creating derivative works, distributing or publicly transmitting any content from the website or application, unless expressly authorized by us;

16. Engaging in any activity that attempts to conceal the illegal origin of funds in the account; and

17. Using your account for election campaigns related to candidates and/or political parties.

Prohibited Goods and Services: Certain goods and services cannot be purchased or sold through the application, even if they are not illegal. This list may change at any time:

1. Stocks and other securities traded on domestic and international stock exchanges, as well as any other banking and financial products, securities, and investment fundraising;

2. Antennas, decoder systems, or any devices intended to decode TV signals;

3. Mailing lists and databases containing personal data and sufficient information to identify individuals;

4. Lotteries, raffles, horse racing, or other animal competitions, unauthorized gambling;

5. Diplomas, certificates, or academic works;

6. Credit or debit cards, whether activated or not, and related services;

7. Collections of programs extracted from specific sources;

8. Factoring or drop shipping;

9. Medications sold only by prescription, tools for the production, operation, or consumption of medications, any medical devices, any type of steroid or enhancer;

10. Counterfeit or imitated domestic and foreign currency and notes, as well as any valuable instruments;

11. Narcotics, drugs, hallucinogenic substances, and their materials for use, as well as controlled pesticides and herbicides;

12. Tools used to unlock or any form of lock picking;

13. Products that require prior approval or registration from government agencies and have not been approved or registered, such as firearms, controlled drugs/narcotics, steroids;

14. Products that alter, copy, modify, or replace programs or operations of mobile devices;

15. Academic software sold at special prices to students and educational institutions;

16. Motor vehicles with document restrictions or any liens;

17. Products or services that pose a risk to consumer safety;

18. Products or services related to financial pyramids, get-rich-quick or easy money schemes, and other multi-level marketing schemes;

19. Any activity considered illegal.

20. Promotions: We may hold promotions for users. To participate in promotions, your account must be active, unrestricted, and in compliance with all terms of this contract and/or promotion rules.

21. Each promotion may have specific rules, and you must comply with these rules to enjoy the advertised benefits. This includes meeting participation deadlines and following the standards provided by PotaPay and/or partners in the promotion or specific rules.

22. The same transaction cannot participate in two promotions simultaneously, so you cannot receive cumulative benefits for the same payment.

23. Our promotions are intended to promote legal transactions within the application. Therefore, any artificial or illegal transactions are not eligible for promotional benefits.

24. We may revoke cashback amounts in the following situations: (a) if you wish to cancel the payment that generated the cashback, and there is available balance in your PotaPay wallet to deduct the received promotional amount; or (b) if the cashback amount is derived from illegal or improper transactions, i.e., transactions without real purpose or payment purpose. Here are some examples of illegal transactions that are not eligible for promotions:

25. i. Transactions between related parties or accounts (automatic reward);

26. ii. Reciprocity transactions; and

27. iii. Transactions between accounts where the account holder does not match the registered information.

28. We may change, suspend, or terminate any promotion, in whole or in part, temporarily or permanently, at any time and without prior notice, for technical reasons or any other reason.

 

Intermediary: The application is a payment platform. We act only as your payment intermediary - at your request, we transfer funds from one user to another. Therefore, we are not responsible for any disputes between you and the interacting party.

If you need to sue your card issuer, recipient, or related third party, we are immediately relieved of any responsibility because we are only intermediaries. For example:

1. If you do not receive the goods prepaid in cash, you do not sue the mint, but the seller who failed to fulfill the obligation.

2. If you do not receive the goods prepaid by bank draft, you do not sue the bank, but the seller who failed to fulfill the obligation.

3. If you use a credit card for a purchase and do not receive the goods, you do not sue the credit card company, but the seller who failed to fulfill the obligation.

4. Similarly, we are akin to the mint, bank, or credit card company in the examples above. We do not guarantee the services or products transacted, merely providing a new payment method. Therefore, we cannot be held liable.

5. We are not responsible for the delivery, specifications, characteristics, quality, quantity, properties, origin, price, functionality, guarantees, defects, and/or damages of goods and services purchased through the PotaPay application.

6. Directed Purchases: You can also purchase products directly from other companies' websites ("third-party companies") through links provided by PotaPay, without any intervention from PotaPay.

7. Given that PotaPay acts only as a redirector to third-party companies' websites in this scenario, you agree that PotaPay assumes no responsibility for the products and/or services obtained through directed purchases, and any complaints and/or requests should be made directly to the third-party company responsible for the product or service.

8. Crypto Assets: You can perform buy and sell operations of crypto assets ("crypto asset operations") through the application. Crypto assets are virtual assets protected by cryptography, existing only in digital records and whose operations are executed and stored on computer networks ("crypto assets").

9. You acknowledge that each buy or sell order in the application represents a formal purchase or sale offer in accordance with applicable laws and the characteristics and prices of the crypto assets. You understand and agree that once your buy or sell order is accepted, the operation will be automatically executed, being irrevocable and unmodifiable.

10. Responsibility: Our relationship needs to be based on trust. Therefore, we have the following duties and responsibilities:

We will make our best effort and follow technical standards to provide services, according to the standards of similar services, but we are not responsible for any damages that may result from service failures or interruptions.

We store your data in a virtual environment with security certificates and public key encryption. According to applicable laws, we will record and store all your operations and transactions and, when necessary, provide them as evidence to administrative, judicial, and/or arbitration authorities.

We cannot guarantee that the application services will be free from failures, continuously available, and protected against damages, attacks, viruses, interference, hackers, or any security attacks, which will be considered force majeure events.

We may, for technical reasons or any other reason, suspend or terminate temporarily or permanently, in whole or in part, any products and services offered through the application, without prior notice.

License: We will grant you a personal, non-exclusive, and limited license to use the application, only for personal access and use. You cannot sell or resell the application or its content. Even if there is a new version of the application, the nature and restrictions of the license remain the same.

Assignment: We may transfer the rights and obligations arising from this contract to third parties, whether or not they belong to the same economic group.

Given that your account is personal and non-transferable, you cannot transfer, directly or indirectly, in whole or in part, the rights under this contract without our written consent, otherwise, this contract will be immediately terminated, and you will not be able to use the application.

Intellectual Property: The application and its parts, systems, and attachments belong to PotaPay. All intellectual property rights related to the application are owned or licensed by us and are protected by Brazilian law. All our users, including you, agree not to copy, modify, transfer or exploit the application without authorization, or attempt to copy or imitate.

Validity Period: We hope our relationship is continuous, so this contract is for an indefinite period. However, we may terminate the contract at any time, without prior notice or compensation.

Communication: You can contact us via email, contact page, or phone number within the application. Feel free to contact us at any time.

Friendly Resolution: We commit to amicably resolving any issues related to this contract. Please contact us, as we are and will continue to be your partners.

Acknowledgment: Having read this far, you confirm and declare that you are aware of the entire content of this contract, fully understand its terms and conditions, and agree to all of them by creating and accessing your account.

Third-Party Content: The application may contain links to third-party websites and applications. When accessing these links, you will enter an environment with other contracts, terms of use, and privacy policies, which are not our responsibility. The existence of these links does not imply any endorsement, sponsorship, or liability relationship between us and these third parties.

Applicable Law: This contract will be interpreted and enforced according to Brazilian law.

Environmental Policy: The cardholder agrees not to use the card for purposes that may cause harm to society and/or the environment, in accordance with the National Environmental Policy and applicable laws.

 

General Provisions

1. Communication: All communications you send to PotaPay will be considered fully valid. On the other hand, all communications sent by PotaPay to you, using any contact information provided on the platform, will be considered valid. Upon receiving an email from PotaPay, especially those requesting data or payments, you must carefully analyze the sender to avoid fraud! If you have any doubts about the forwarded message, you must contact PotaPay through customer service channels.

2. Invalid Statement: If any term or condition of these terms is deemed invalid or null by any court, the validity of the other terms will not be affected, and these will remain fully valid and effective to the maximum extent permitted.

3. PotaPay's failure to enforce any right or provision of these terms does not constitute a waiver, and it may regularly exercise its rights within the statutory period.

Intellectual Property

You understand that all texts, images, photographs, projects, data, videos, illustrations, icons, technologies, links, and other audiovisual or sound content, including the platform's software, graphic design, and/or source code, are proprietary. They are owned by PotaPay or third parties who authorize its use on the platform, and are protected by international laws and treaties. Reproduction, copying, or any other type of use is prohibited, and violators will be subject to corresponding civil and criminal sanctions under laws No. 9,279/96, 9,609/98, and 9,610/98.

Any type of brand, trade name, or logo presented on the platform belongs to PotaPay or third parties that allow its use. Therefore, using the platform does not imply authorization for you to reference such brands, trade names, and logos.

If you identify any intellectual property infringement, you can report it through our service channels so that PotaPay can investigate the reported situation and take necessary measures to investigate and resolve any infringement.

Privacy

How do we use your data?
How do we obtain your personal data?

In some cases, personal data is provided by you when you register or use one of our services. In other cases, we collect it automatically when you browse our pages or through trusted sources.

We collect your data in the following situations:

1. When you register on the app;

2. When you purchase products and services and use our app or website;

3. Apart from complying with legal obligations, to the extent necessary to conduct our activities and improve our products and services;

4. Through business partners and service providers.

You are not obliged to provide us with your personal data, but this is essential for you to use our services and enjoy all the functionalities of our platform.

Providing inaccurate or false personal data may result in the suspension of services. Additionally, if you violate this privacy statement, we may suspend or permanently disable your account.

We use your personal data to provide a bureaucracy-free, delay-free payment experience without the need to carry wallets, cards, and cash. We may also process your data to contact you when necessary, comply with legal and regulatory obligations, exercise our rights and obligations in judicial, administrative, or arbitration proceedings, maintain your registration, and ensure your safety when browsing our website.

Additionally, we need to take fraud prevention measures to protect you, and we also need your data to help resolve your complaints, problems, and requests.

If you decide to leave us, we will respect your decision and close your account and your data, unless the law requires or allows us to retain this data.

What types of data do we collect?

Data you provide directly when you register or use our services:

1. Name chosen to operate on the platform.

2. Full name, personal image (personal photo or photo of identification document).

3. Valid document or National Insurance Number / Company Registration Number or VAT Number.

4. Information extracted from document photos, such as personal photo.

5. Contact information (such as phone number, address, email).

6. Bank account data.

7. Information and payment methods, such as payment details and how you pay.

8. Records of communications made.

Data we collect automatically, whether or not you are registered:

1. Internet IP address used when connecting to our services or browsing our website.

2. Transaction and movement data within the platform (purchases, payments, returns, issues, withdrawals, transfers, prepaid card movements, points, prepayments, claims, invoices, tax data, bank account, internal messages).

3. Data about user and visitor activities within our website and application.

4. Credit data obtained from credit risk databases or centers and/or publicly accessible sources, according to applicable laws.

5. Data used to verify your identity, correct and/or complete your information, obtained from secure and reliable sources.

Public organizations, service providers, or business partners we collaborate with. In some cases, according to applicable law, this data may be considered sensitive data. In these cases, we request your explicit consent for processing.

When you create an account with us, we will ask you to provide your full name as described in your documents. According to our contractual rules, we will also require your phone number, your email, and your date of birth. These data are very important for us to provide a secure and fully functional payment platform and are necessary to fulfill the legal obligations we must comply with as a payment institution. We may also process your personal data for the purposes described in this policy, which helps improve your experience with us and allows us to offer more reliable products and services.

If you authorize access, we will collect the names, emails, and phone numbers of your contacts. These data are very important so that we can connect you with your friends, creating an interactive social network that allows you to view, like, and comment on activities and transactions performed by your friends in the app. However, rest assured that no financial information will be displayed, not even to your friends. Your profile will remain closed, so users accessing your profile will not be able to view, comment on, or like your activities. As for payments, only the people making or receiving the payment will be able to see them, comment, and/or like them. You can also change the current privacy settings in the app at any time. Therefore, when you enter the app and create an account, please review how you want to participate in our social network and manage your privacy preferences in the "Settings" menu.

To meet the purposes set forth in this contract and the privacy policy, we may share your personal data by taking the necessary technical and organizational measures according to applicable law, including:

Service partners located in Brazil or abroad;

Regulatory and public entities, including administrative and judicial bodies;

Strategic partners to offer products and services.

How do we share your data?
Can your personal data be shared?

Yes, we may share your personal data, but only for specific purposes supported by law, to the extent necessary to conduct our activities, provide and improve our products, features, and services, and ultimately with:

1. Public, government, judicial, or administrative entities;

2. Business partners, who may share this information with their respective business partners and service providers.

Rest assured, we have adopted policies, procedures, and mechanisms, such as contractual instruments and audits, to ensure that recipients of your personal data handle them appropriately. It is equally important for you to know that your personal data may be transferred outside of Brazil for specific purposes and in accordance with the law, always ensuring that such transfer occurs only to countries or regions that offer a similar level of security to that provided in Brazil.

With whom do we share your data?

We do not sell or market data that can identify our users. We also do not share or transfer your personal data to third parties unless:

Service providers: They provide services according to our instructions and as stipulated in this privacy statement to improve or facilitate the operation of our platform, such as:

a) Transportation, logistics, delivery, and parcel companies to send the products you purchase.

b) Intermediaries for payment methods, payment management, or insurance to receive payment for contracted services or products and provide protection for purchased products.

c) Computer systems providers, cloud service providers, database providers, and technology service providers.

d) Customer service centers.

e) Companies managing loyalty programs to provide benefits to you.

f) Data analysis consultants.

g) Government entities or companies specializing in risk to verify your information.

Business allies: Business partners who have a collaborative relationship with our platform to offer their promotions, products, and services or co-branded products and/or fulfill legal obligations. We may also share user information with business partners to prevent fraud and ensure a secure and sustainable environment on our platform. We always strive to meet confidentiality and security standards through the signing of agreements or accords.

Public authorities: Administrative and judicial authorities that need data in the exercise of their jurisdiction or decide to share data with third parties without administrative or judicial subpoena, for the purpose of:

(a) Cooperating in investigations and reporting fraud, piracy, infringement of intellectual or industrial property rights, or any other illegal activity, and any activity that may result in legal liability for PotaPay and/or its users.

 (b) Protecting the public interest, justice, exercising, or defending specific rights in judicial or administrative proceedings, and/or resolving disputes.

(c) Complying with any applicable law, regulation, or legal provision, or any authorization from a competent authority for a just and motivated reason.

Public or private entities that provide information or credit risk services, sharing data related to your credit behavior or compliance or non-compliance with asset-related obligations, whenever permitted by law.

When we evaluate that there are sufficient reasons to believe that your activities are suspicious (attempted crime), we may disclose your personal data to other users of the site and/or services, entities, or third parties to prevent harm to others.

Sale or transfer of credit: If we decide to share your data with third parties other than those mentioned in this privacy statement, we will seek your prior consent.

How do other users use your data?

We allow users limited access to certain personal data to facilitate their interactions. For example:

1. Name.

2. Nickname.

3. Email.

4. Other contact details.

Under no circumstances may sellers transmit your personal data to third parties without your consent. When a user receives another user's personal data, he or she is responsible for handling these data and fulfilling the legal obligations stipulated by data protection laws.

What rights do you have?

1. To know whether your personal data is being processed, how it is being processed, and which data will be processed, as we informed you above.

PotaPay will not be responsible for:

1. Any unavailability, errors, and/or failures of the platform;

2. Errors and/or inconsistencies in data transmission over the network and errors and/or inconsistencies related to the quality or availability of the internet connection, which may prevent our platform or you from receiving information properly;

3. Outdated, incomplete, and/or untrue data provided by the platform;

4. Any damages resulting from the use of the platform in violation of these terms;

5. Any devaluation in transactions/applications made by you and any losses you may incur as a result;

6. Damages resulting from failures entirely related to you or third parties beyond our reasonable control, which may lead unauthorized third parties to access data provided through the platform;

7. The presence of viruses or other harmful elements on the platform that can cause changes to your computer systems (software and hardware) or to electronic documents stored on your computer systems.

Sanctions: Account Freezing and Termination

If irregularities, fraud, money laundering, or other criminal activities are detected in your registration information, violation of this contract, or non-compliance with the obligation to update the application, or if PotaPay considers any behavior harmful to its business activities, we may refuse, suspend, freeze, interrupt (in whole or in part), or permanently terminate the provision of products, services, and/or access to the application at any time without prior notice.

Duration or Termination of Access

The platform will be available indefinitely. PotaPay reserves the right to modify, suspend, or terminate access to the platform at any time, with prior notice to take appropriate measures.
